With the proposed amendment to the Product Safety and Technical Regulations Law No. 7223, it is aimed to impose deterrent penalties on companies that export unsafe products. As stated in the justification of the draft law, pursuant to the fourth paragraph of Article 20 of the Product Safety and Technical Regulations Law No. 7223, it is envisaged that administrative fines for unsafe products placed on the market will be taken as a basis in determining the administrative fine due to the difficulties experienced in determining the FOB price and the fact that the FOB price for the exported products is lower than the Turkish Lira ranges for the products targeted to be exported.

Accordingly, in the fourth paragraph of Article 20 of the Product Safety and Technical Regulations Law dated 05/03/2020 and numbered 7223, the phrase “Turkish Lira in the amount corresponding to 5% to 25% of the actual FOB price of the product subject to nonconformity” is changed to “from  240.566 Turkish Liras  to 2.405.665 Turkish Liras in case of product safety violations,  from  96.226 Turkish Liras up to  962.265 Turkish Liras  in other violations “.
